100AM Mall is owned and managed by Amara Hotel Properties Pte Ltd, a subsidiary of Amara Holdings Limited.
1. Why you are at this place
By posting, sharing, or otherwise making available content that references, tags, or features 100AM Mall (including through hashtags, location tags, or other identifiers), you acknowledge and agree that such content may be used by 100AM Mall and its related entities.
You grant 100AM Mall a non-exclusive, royalty-free, worldwide right to collect, reproduce, display, publish, distribute, and otherwise use such content for marketing, promotional, informational, or related purposes, across all media platforms and formats, whether now known or developed in the future.
You further confirm that you own the rights to the content or have obtained all necessary permissions to allow such use, and that the use of your content by 100AM Mall will not infringe the rights of any third party.
If you do not agree to these terms, please refrain from tagging, mentioning, or otherwise associating your content with 100AM Mall.
2. Terms
(a) About you
By agreeing to these Terms, you represent and warrant that:
- You are at least 18 years old or considered a legal adult in the jurisdiction you reside in.
- You have the ability and authority to agree to these Terms.
(b) Collection, Storage, Transmission, Publication and/or Use
The User Content will be used for commercial or business-related purposes, including without limitation the promotion and marketing of 100AM’s, products, and services; and the collection of data from potential or actual patrons for market study and/or loyalty programmes.
We engage third-party service providers to facilitate the collection, storage, transmission, publication and/or use of content on our websites, social media channels, print materials and other promotional materials (collectively “100AM Content”).
Accordingly, your agreement to these Terms constitutes irrevocable consent to the collection, storage, transmission, publication and/or use of the User Content by 100AM, our business partners and service providers for the stated purposes.
Your consent will not lapse even if you later remove the User Content from your social media or change your username, privacy settings, or account status.
(c) User Content
The User Content may include photos, videos, graphics, sound recordings, comments, or combinations thereof.
You confirm that you own all rights to the User Content and that it does not infringe upon any third-party rights, including intellectual property or privacy rights.
User Content must not contain any illegal, defamatory, obscene, offensive or objectionable material.
If your User Content includes other individuals, you confirm that you have obtained their consent (or that of a parent/guardian in the case of minors) for 100AM to collect, store, transmit, publish and/or use their likeness or personal data for the stated purposes.
(d) License
By agreeing to these Terms, you grant 100AM a non-exclusive, royalty-free, worldwide, perpetual, transferable, irrevocable and fully sub-licensable license to use, reproduce, modify, adapt, publish, distribute, and display the User Content (in whole or part) for any purpose related to 100AM’s business.
You also grant 100AM the right to use your personal data (such as your username, name, image, likeness, or location) in connection with such use of the User Content.
100AM reserves the right to edit, remove, or discontinue use of the User Content at any time.
Your consent constitutes an irrevocable waiver of any rights or claims against 100AM regarding the use of the User Content.
(e) Privacy Policy
100AM’s privacy policy, as published on our website, forms part of these Terms. By agreeing to these Terms, you acknowledge and consent to 100AM’s collection, storage, transmission, publication, and use of your personal data in accordance with that policy.
You may be asked to provide your full name, contact details, and email address for attribution or verification purposes.
(f) Limitation of Liability
You shall indemnify 100AM against any claims, losses, or liabilities arising from your breach of these Terms or your User Content.
100AM shall not be liable for any indirect, incidental, or consequential damages, including loss of profits or data, arising from the use of your User Content.
Your sole remedy shall be to request 100AM to cease future use of your User Content in new promotional materials.
(g) Miscellaneous
These Terms are governed by the laws of the Republic of Singapore, and you agree to the exclusive jurisdiction of the Singapore courts.
100AM reserves the right to amend these Terms at any time by posting an updated version on its website. Continued consent or new approvals will be subject to the revised Terms.
3. Contacting 100AM
100AM respects the intellectual property of others. If you believe your User Content has been used in a way that infringes your rights, please contact us in writing with proof of such infringement.
If verified, 100AM may cease future use of such content in new materials or, with your agreement, continue using it with proper attribution.
